Below you will find information on what personal data (this is all data that identifies or makes you identifiable as a natural person (hereinafter referred to as "data subject"), such as name, address, e-mail address or even user behavior) we collect during your visit to our site and how this data is used. Affected persons are the visitors of our website and users of our online services.

2.    RIGHTS CONCERNED

According to Art. 15 DSGVO you have the right to receive information about the data stored about you, including any recipients and the planned storage period. Should incorrect personal data be processed, you have the right to correction according to Art. 16 DSGVO. If the legal requirements are met, you can demand the deletion or restriction of the processing as well as object to the processing (Art. 17, 18 and 21 DSGVO).
If you wish to have your data deleted, but we are still legally obliged to retain it, access to your data will be restricted (blocked). The same applies in case of an objection. You can exercise your right to data transferability as long as the technical possibilities are available to the recipient and to us.

3.    LEGAL BASIS

The legal basis of our data processing is the following according to Art. 13 DSGVO:

  • Art. 6 Paragraph 1 S. 1 a) DSGVO for the processing of personal data with the consent of the data subject.
  • Art. 6 para. 1 sentence 1 b) DSGVO for the processing of personal data necessary for the performance of a contract with the data subject and for the implementation of appropriate pre-contractual measures.
  • Art. 6 para. 1 sentence 1 c) DSGVO for the processing of personal data necessary for the performance of a legal obligation to which we are subject under any applicable law of the EU or under the law of any country in which the DSGVO is applicable in whole or in part.
  • Art. 6 para. 1 sentence 1 f) DSGVO for the processing of personal data necessary to protect the legitimate interests of us or of third parties, unless the fundamental freedoms and rights and interests of the data subject outweigh these.

Legitimate interests are in particular our commercial interest in being able to provide our website, information security, the enforcement of our own legal claims and compliance with other legal provisions.
To this end, we use service providers who are separately bound to secrecy and data protection in the course of providing our services. We will only pass on information to public authorities in the event of overriding legal provisions.

RIGHT OF REVOCATION

PURPOSES OF PROCESSING

General: Presentation of the company, provision of services and/or sale of products as well as communication via the Internet. The purpose of data processing on this website is to provide information about products and services of our company and, if applicable, to process applications with the possibility for the user to get in touch with the contact persons in our company.

4.    GENERAL

If you have expressly given us your consent to do so or if this is permitted under data protection law, we may also process your personal data for the following purposes:

  • Communicating with you through your approved communication channels to keep you informed of the latest announcements, special offers, or other information about ProXES' and its brands' products, technologies, and services (including marketing-related newsletters), as well as ProXES' events and projects.
  • Responding to your inquiries
  • Advising and handling contracts concluded with you
  • technical administration

Your personal data will only be disclosed to third parties or otherwise transferred if this is necessary for the purpose of contract processing or for billing purposes, or if you have previously consented. You have the right to revoke your consent at any time with effect for the future (see right of revocation). The legal basis for the collection, processing and forwarding of the data is Art. 6 para. 1 p. 1 b) DSGVO in the context of contract processing. The deletion of this data takes place after the expiry of the applicable statutory retention obligations. If we are not subject to any statutory retention obligations, the data will be deleted when the purpose ceases to apply. You have the right to information and the right to object to your data stored by us at any time. You can find further information under "Data subject rights" and "Right of revocation".

5.    SERVER DATA COLLECTION

PURPOSE OF THE PROCESSING

When you visit our site, various server statistics are automatically stored, which your browser sends to the server of our provider: Among other things, the IP address of your device, date and time of access, name and URL of accessed files, website from which the access takes place or from which you were directed to our site (referrer URL), browser used and, if applicable, the operating system of your device as well as the name of your provider are logged.

The above-mentioned data is processed by us for the purpose of smooth connection establishment and system security. A consolidation of this data with other data sources is not carried out. The IP address will be anonymized. The resulting connection data is automatically deleted; usually after a maximum of thirty days. If the website is misused, log data, whose further storage is required for evidentiary purposes, will be kept until the incident has been clarified.

The legal basis is Art. 6 para. 1 p. 1 f) DSGVO. Our legitimate interest arises from the fact that we want to ensure a secure operation of the website and to detect possible attacks.

6.    CONTACT FORM AND REQUEST BY E-MAIL

PURPOSE OF THE PROCESSING

When using our contact form, we collect and store the name and e-mail address for the purpose of answering your request. The specification of the telephone number for a call back is optional. If you send us a contact request by e-mail, we collect and store the e-mail address and the data contained in the e-mail.

The legal basis is Art. 6 para. 1 p. 1 a) DSGVO, because by using the form as well as sending an e-mail you agree to the above mentioned processing of your data. In addition, the legal basis is also derived from Art. 6 para. 1 p. 1 b), as the storage of the data is necessary for the fulfilment of a pre-contractual or possibly later contractual relationship.

The data will be deleted when the purpose of storage has ceased to apply, i.e. after your e-mail/contact form inquiry has been answered or when the matter associated with the inquiry has been finally clarified. You have the right to revoke the given consent at any time without affecting the legality of the processing carried out on the basis of the consent.

7.    PROXES ACCOUNT REGISTRATION

PURPOSE OF THE PROCESSING

When registering for a user account, we collect and store the name and email address for the purpose of creating a personalized account. The legal basis is Art. 6 para. 1 p. 1 b), as the storage of the data is necessary for the creation of this account. The deletion of the data takes place when the purpose of the storage has ceased to exist, i.e. after deletion of the user account on the part of the user. Regarding the right to deletion and information, you can find information under "Data subject rights".

8.    ONLINE APPLICATIONS

PURPOSE OF THE PROCESSING

If you apply to us on the basis of a job advertisement, we will collect your personal data such as first name, surname, address, telephone number, e-mail address, attachments (cover letter, CV, certificates, photo) and store them for the duration of the selection process.
By activating the checkbox and sending the form, you expressly agree that we may collect, process and use the data you provide us with, in particular sensitive information about mental and physical health, racial or ethnic origin, political opinions, religious or philosophical beliefs, membership in a trade union or political party or sex life, for the purpose of the application.

Your data will only be used by authorized persons of the human resources department or the management for processing within the selection process. Your personal data will not be passed on to third parties. If the specific position for which you are applying has already been filled elsewhere, but your profile makes you suitable for a later position or for working in a partner or subsidiary, we will obtain your express consent before storing or forwarding your application, unless you have already agreed to such storage or forwarding in your application.

If you send us an unsolicited application using our general contact e-mail address, the contents of your application e-mail can be viewed by unauthorized personnel. It is the rule that the unopened application documents are immediately forwarded to the personnel department and the incoming mail is deleted. If you would like to exclude this, please contact us by telephone before submitting your unsolicited application so that you can be given the contact details of the correct contact person.

The legal basis is Art. 6 para. 1 p. 1 b) DSGVO, for the processing of pre-contractual measures.

Unless you inform us to the contrary, the data will be deleted 6 months after completion of the application procedure or, in the case of postal applications, destroyed. Due to the long application and selection periods for trainees, we store their data in Germany for up to 18 months.

If the respective legal requirements are met, you have the following rights: Right to information about your data stored with us, correction, deletion, restriction of the processing of your data or objection to the processing, as well as to data transferability. 9.    USE OF HUBSPOT

PURPOSE OF THE PROCESSING

Our registration service enables visitors, after giving their consent (Art 6 para.1 lit. a DSGVO) on our website to learn more about our company, download content, and provide their contact information and other demographic information. This information is stored on servers of our software partner HubSpot. It may be used by us to contact visitors to our website and to determine which of our company's services are of interest to them. You can revoke your consent for the future at any time. We will comply with your request within 48 h for organizational reasons.

HubSpot requires the following data: Name, address, email, IP address, company and job title, field of activity. We use HubSpot for our online marketing activities. This is an integrated software solution that we use to cover various aspects of our online marketing.

These include, but are not limited to:

  • Content management (website and blog)
  • Email marketing (newsletters and automated mailings, e.g. to provide downloads)
  • Social media publishing & reporting
  • Reporting (e.g. traffic sources, hits, etc.)
  • Contact management (e.g. user segmentation & CRM)
  • Landing pages and contact forms

We use all collected information exclusively to optimize our marketing. HubSpot is a software company from the USA with a branch in Ireland. HubSpot responded by setting up a data centre in Europe and introducing standard contractual clauses to ensure a secure level of data protection.

10.    USE OF MATOMO

PURPOSE OF THE PROCESSING

The web analytics service Matomo (Piwik) is used on this website. No cookies are used for this purpose. If you do not agree with the storage and analysis of this data from your visit, then you can object to the storage and use below by mouse click at any time. In this case, a so-called opt-out cookie is stored in your browser, which means that Matomo does not collect any session data. Please note that the complete deletion of your cookies means that the opt-out cookie will also be deleted and may have to be reactivated by you.

The legal basis is Art. 6 I (f) DSGVO. Our legitimate interest arises from the fact that we make adjustments for optimization and marketing purposes as well as for security based on the statistical analysis of user behavior.

11.    COOKIES & CONSENT MANAGEMENT

PURPOSE OF THE PROCESSING

We use the consent management tool CCM19 on our website by means of an installation of the agency Just Ebert Design GmbH commissioned by us. The tool enables you to give consent to data processing via the website, in particular the setting of cookies, as well as to exercise your right of revocation for consent already given. Data processing serves the purpose of obtaining and documenting required consents to data processing and thus complying with legal obligations. Cookies may be used for this purpose. Among other things, the following information is collected and transmitted to Just Ebert Design: Date and time of the page view, a random ID, Consent Status. The website operator does not process the data itself; the data is stored as a log file. An access to the logfiles of our customers takes place only by previous arrangement and agreement of the customer. This data is not passed on to other third parties. Data processing is carried out to fulfill a legal obligation on the basis of Art. 6 para. 1 lit. c DSGVO.
